Website and Platform Terms of Use

1. Introduction

These Terms of Use govern access to and use of the website, online accounts, forms, portals and digital services operated by the Independent Candidates Alliance.

By accessing or using the ICAlliance website or creating an account, you agree to comply with these Terms.

Where you use a specific service, additional rules, policies or declarations may also apply. These may include:

• The Constitution of the Independent Candidates Alliance
• Membership rules
• Candidate-selection policies
• Candidate standards and declarations
• Volunteer terms
• Donation terms
• The Privacy & POPIA Notice
• The PAIA Manual
• Rules governing a particular community, ward or electoral process

Where a specific policy applies to a particular activity, that policy must be read together with these Terms.

3. Acceptance of these Terms

You accept these Terms when you:

• Visit or use the website
• Create or use an account
• Submit a form
• Apply for membership
• Apply or agree to be considered as a candidate
• Nominate another person
• Register as a volunteer
• Subscribe to communications
• Participate in an online consultation or selection process
• Upload information or documents
• Use any other ICAlliance digital service

If you do not agree with these Terms, you must not use the relevant service.

Merely visiting publicly available pages does not make a person a member, candidate, volunteer or authorised representative of ICAlliance.

4. Eligibility

The general public may access publicly available website content.

Certain services may have additional eligibility requirements. For example:

• Membership may be restricted by the Constitution or membership rules.
• Candidate applications are subject to age, voter-registration, legal and electoral requirements.
• Participation in a ward or municipal process may require proof of residence, voter registration or community connection.
• Some services may only be used by adults.
• A person acting for an organisation must have authority to do so.

Using the website does not establish that a person is eligible for membership, candidacy, participation or any other ICAlliance status.

5. User accounts

Some website functions require a registered account.

When creating or using an account, you must:

• Provide accurate and complete information
• Keep your information reasonably current
• Use your own identity unless formally authorised to act for another person
• Keep your password and login details confidential
• Take reasonable steps to prevent unauthorised access
• Notify ICAlliance promptly if you suspect unauthorised use
• Use the account only for lawful and authorised purposes

You may not:

• Create a false or misleading account
• Impersonate another person
• Create accounts in bulk or through automated means
• Transfer or sell an account
• Allow another person to use an account to evade eligibility or participation rules
• Attempt to access another person’s account
• Circumvent account restrictions or security controls

You are responsible for activity conducted through your account until ICAlliance has been notified of suspected compromise and has had a reasonable opportunity to act.

6. Accuracy of information

You are responsible for ensuring that information submitted through the website is accurate, complete and not misleading.

You must notify ICAlliance if material information changes, including information affecting:

• Identity
• Contact details
• Municipality or ward
• Voter-registration status
• Membership eligibility
• Candidate eligibility
• Conflicts of interest
• Criminal or disciplinary declarations
• Public profile information
• Volunteer availability or assignment

Providing information through the website does not prevent ICAlliance from requesting supporting documents, conducting verification or obtaining information from lawful and authorised sources.

ICAlliance may correct obvious administrative errors but is not obliged to alter a person’s substantive declaration without appropriate confirmation.

7. Membership applications

Submitting a membership application does not automatically create membership.

Membership is subject to:

• The Constitution
• Applicable membership rules
• Eligibility requirements
• Verification where required
• Approval through the prescribed process
• Any applicable fees or approved waiver
• Continued compliance with ICAlliance rules and standards

ICAlliance may approve, decline, suspend or terminate membership only in accordance with the applicable governing documents and fair procedures.

8. Candidate applications

Submitting a candidate application does not guarantee:

• Acceptance as an applicant
• Eligibility
• Invitation to continue the process
• Approval as a candidate
• Selection by a community
• Placement on a proportional-representation list
• Submission to the Electoral Commission
• Acceptance by the Electoral Commission
• Election to public office

Candidate applications may be subject to:

• Identity and voter-registration verification
• Eligibility declarations
• Background and conflict checks
• Supporting documents
• Community engagement
• Interviews or assessments
• Membership or constitutional requirements
• Candidate standards
• Community selection
• Electoral deadlines
• Electoral Commission requirements
• Availability of resources and organisational capacity

ICAlliance may place an application on hold, request further information, correct an administrative status or end an application where the applicable requirements are not met.

Material adverse decisions should be taken in accordance with the relevant policy and fair procedure.

9. Community nominations

A person may nominate another individual where the website provides a nomination process.

By submitting a nomination, the nominator confirms that:

• The information provided is believed to be accurate
• The nomination is made in good faith
• The nomination is not intended to harass, embarrass or misrepresent the nominee
• The nominee’s private information will not be published without the required confirmation or lawful authority
• The nominator understands that nomination does not create candidacy

ICAlliance may contact the nominee to confirm interest and consent.

A nominee is not required to accept a nomination. A nomination may be declined, withdrawn, archived or removed where the nominee does not consent or where the applicable requirements are not met.

10. Candidate and public profiles

Approved candidate, representative or office-bearer information may be displayed publicly where this is necessary for electoral participation, transparency or public accountability.

Public information may include:

• Name
• Photograph
• Municipality and ward
• Biography
• Relevant experience
• Reasons for standing
• Community work
• Public commitments
• Ward priorities
• Manifesto
• Approved public contact channels
• Application, selection or verification status intended for public display

Users must not publish private residential addresses, identity numbers, confidential verification records or other information that is not approved for public display.

ICAlliance may edit the layout, formatting, spelling or technical presentation of profile information without changing its substantive meaning.

A person remains responsible for the truthfulness of statements submitted for public display.

11. Community participation and voting processes

Where ICAlliance conducts a consultation, nomination, primary, selection, petition or other community process, additional rules may apply.

Participants must:

• Use their own identity
• Participate only where eligible
• Submit only one response or vote where the rules allow one
• Avoid coercion, intimidation, inducements or manipulation
• Refrain from automated, fraudulent or duplicate participation
• Respect confidentiality where a secret process is used
• Follow any applicable deadline and verification process

ICAlliance may investigate irregularities, invalidate fraudulent participation, correct administrative errors or repeat a process where required by the applicable rules.

Website availability, account creation or form submission alone does not prove eligibility to participate.

12. Volunteers

Volunteer registration does not guarantee placement, appointment or continued assignment.

Volunteers may be required to:

• Complete verification
• Accept a role description
• Follow lawful instructions
• Protect confidential and personal information
• Use ICAlliance systems responsibly
• Comply with codes of conduct
• Return records, access credentials or property
• Refrain from representing themselves as authorised spokespersons unless appointed

ICAlliance may change, suspend or end a volunteer assignment where reasonably necessary.

Volunteer participation does not create employment unless a separate written employment agreement is concluded.

13. User-submitted content

User-submitted content includes text, photographs, documents, comments, profiles, submissions, issue reports, manifestos, media and other material supplied through the website.

You retain ownership of content you lawfully own.

By submitting content for publication or use within an ICAlliance process, you grant ICAlliance a non-exclusive, royalty-free licence to:

• Store and reproduce it
• Format and display it
• Use it for the purpose for which it was submitted
• Publish it where publication was clearly intended or authorised
• Include it in relevant electoral, governance, training, communication or accountability material
• Archive it where reasonably necessary

This licence does not authorise ICAlliance to sell your personal content for unrelated commercial purposes.

You confirm that:

• You have the right to submit the content
• It is not knowingly false or misleading
• It does not unlawfully infringe another person’s rights
• It does not disclose confidential information without authority
• Any person shown or identified has provided the required consent where applicable

ICAlliance may remove, restrict or decline to publish content that breaches these Terms or applicable law.

14. Prohibited conduct

You may not use the website or platform to:

• Break the law
• Commit fraud or misrepresentation
• Impersonate another person
• Interfere with an election or community process
• Submit false voter, candidate or membership information
• Harass, threaten, intimidate or unlawfully discriminate
• Defame another person
• Publish private information without lawful authority
• Upload malicious software or harmful code
• Probe or bypass security controls
• Access restricted information without authority
• Scrape, copy or harvest personal information
• Send spam or unauthorised marketing
• Manipulate votes, nominations, likes, follows or participation figures
• Use automated tools to create accounts or submissions
• Disrupt the website or place unreasonable demands on its infrastructure
• Use ICAlliance branding in a misleading or unauthorised manner
• Present personal views as official ICAlliance policy without authority
• Solicit money in the name of ICAlliance without written authorisation
• Use the platform to promote violence, hatred or unlawful activity

ICAlliance may investigate suspected misuse and preserve relevant records.

15. Moderation

ICAlliance may moderate content and participation to protect:

• Lawful political discussion
• Fair candidate and community processes
• Personal information
• Website security
• The rights and safety of users
• The integrity of its governance and electoral systems

Content may be removed, restricted or referred for review where it:

• Breaches these Terms
• Is unlawful
• Contains personal information published without authority
• Is fraudulent or materially misleading
• Is abusive or threatening
• Interferes with a formal process
• Creates a security risk
• Violates an applicable code or policy

Moderation does not mean that ICAlliance endorses all content that remains visible.

16. Intellectual property

Unless otherwise stated, the website design, original text, graphics, logos, videos, documents, software and other original material are owned by or lawfully licensed to ICAlliance.

You may:

• View the website for personal and public-information purposes
• Download documents made available for download
• Share links to public pages
• Quote reasonable extracts with proper attribution
• Use authorised campaign resources in accordance with their stated licence or instructions

You may not, without permission:

• Reproduce substantial parts of the website
• Remove ownership or attribution notices
• Sell or commercially exploit ICAlliance content
• Modify official documents and present them as authentic
• Use the logo, name or brand to imply endorsement
• Copy private portal material
• Republish personal information from the platform for unrelated purposes

Official documents must not be altered and represented as approved ICAlliance documents.

17. Third-party content and links

The website may link to or embed content from third parties, including:

• The Electoral Commission
• Municipalities
• The Information Regulator
• Social-media services
• Mapping services
• Payment providers
• Media organisations
• Other public or professional sources

A link does not necessarily constitute endorsement.

ICAlliance does not control third-party websites and is not responsible for their availability, security, terms, privacy practices or content.

Users should review the terms and privacy notices of third-party services.

18. Electoral and municipal information

ICAlliance aims to provide accurate voter, ward, municipality, candidate and election information. However:

• Electoral boundaries may change
• Voter-registration information may change
• Timetables and deadlines may be amended
• Candidate status may change
• The Electoral Commission remains the authoritative source for official electoral information
• Municipal and public records may contain errors or delays

Users should confirm critical election information directly with the Electoral Commission.

Registration with ICAlliance does not register a person as a voter and does not amend the official voters’ roll.

19. Website availability

ICAlliance aims to keep the website and platform reasonably available but does not guarantee uninterrupted or error-free operation.

Access may be affected by:

• Maintenance
• Hosting interruptions
• Software errors
• Security incidents
• Power or network failures
• Third-party services
• High traffic
• Events beyond reasonable control

ICAlliance may suspend or limit access where necessary for maintenance, security, compliance or system integrity.

Users should not rely on the website as the only method of meeting a legal or electoral deadline.

20. Security

Users must not attempt to compromise the security of the website or another user’s information.

ICAlliance applies reasonable security safeguards but cannot guarantee that electronic systems will always be free from risk.

You should:

• Use a strong password
• Keep login details private
• Log out on shared devices
• Avoid sending confidential documents through insecure channels
• Report suspected unauthorised access promptly

21. Privacy and personal information

Personal information is processed in accordance with the ICAlliance Privacy & POPIA Notice.

By using the website, you acknowledge that information may be processed for the relevant service, subject to applicable law and the notices displayed when information is collected.

These Terms do not constitute unlimited consent to process personal information.

22. Electronic communications

You agree that ICAlliance may communicate electronically where you provide an email address, mobile number or account.

Electronic communications may include:

• Account notices
• Application updates
• Verification requests
• Security notices
• Governance notices
• Meeting and event information
• Candidate or community-process information
• Newsletters and political communications where lawfully authorised

You may unsubscribe from optional marketing communications. This will not prevent ICAlliance from sending necessary administrative, legal, security or process-related communications.

Electronic records and notices may be retained as evidence of communication, consent, submission or acceptance.

23. Donations and payments

Donations and payments are subject to separate Donation Terms, political-funding requirements and any conditions displayed during the transaction.

Submitting a donation does not:

• Purchase membership
• Guarantee candidate approval
• Influence candidate selection
• Create a right to direct ICAlliance decisions
• Create a right to repayment except where required by law or the applicable Donation Terms
• Entitle the donor to confidential information

ICAlliance may refuse or return a donation where acceptance would be unlawful, prohibited by policy or administratively impracticable.

24. Suspension or termination of access

ICAlliance may suspend, restrict or terminate access to an account or service where reasonably necessary because:

• These Terms have been breached
• Information is materially false or misleading
• Security has been compromised
• The account is being misused
• An investigation is required
• The user is no longer eligible
• Continued access could prejudice another person or a formal process
• Access is no longer required
• The law or an authorised body requires it

Where appropriate, the user will be informed of the reason and any available review or appeal process.

Suspension of website access does not automatically determine membership, candidacy or disciplinary status where a separate governing process applies.

25. Disclaimers

The website provides political, organisational, electoral and public-participation information.

Unless expressly stated otherwise:

• Website content is general information
• It is not legal, financial or professional advice
• Publication does not create a contractual promise of candidacy, selection, funding, employment or election
• Public comments and user submissions do not necessarily represent ICAlliance’s views
• Draft or archived documents should not be treated as current policy
• The signed or formally adopted version of an official document remains authoritative

Users should obtain appropriate professional advice where required.

26. Limitation of liability

To the extent permitted by law, ICAlliance will not be liable for indirect, incidental, special or consequential loss arising from:

• Temporary website unavailability
• Reliance on information that has changed
• Third-party websites or services
• Unauthorised use of an account where the user failed to protect login details
• User-submitted content
• Events outside ICAlliance’s reasonable control

Nothing in these Terms excludes or limits liability where exclusion is prohibited by law.

Nothing excludes liability for fraud, intentional misconduct or any liability that cannot lawfully be excluded.

27. Responsibility for breaches

A person who unlawfully accesses the platform, interferes with its operation, submits fraudulent information or infringes another person’s rights may be held responsible for resulting loss or harm to the extent permitted by law.

ICAlliance may report suspected criminal conduct, electoral misconduct or unlawful access to the appropriate authority.

28. Changes to these Terms

ICAlliance may update these Terms where:

• Website functions change
• New services are introduced
• Legal requirements change
• Governance policies are adopted
• Security or administrative processes change

The current version and effective date will be published on this page.

Material changes may also be communicated to registered users where appropriate.

Continued use after the effective date of updated Terms constitutes acceptance only to the extent permitted by law. Where fresh consent or express acceptance is required, ICAlliance will request it.

29. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue to apply.

An invalid provision will be interpreted or limited only to the extent necessary to make it lawful and enforceable where possible.

30. No waiver

A failure or delay by ICAlliance in enforcing a provision does not waive the right to enforce that provision later.

31. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of South Africa.

Any dispute will be dealt with by a court or other forum with lawful jurisdiction, subject to any applicable internal process, statutory complaint procedure or alternative dispute-resolution mechanism.
